The following is a statement by John Ford, a member and resident of Occupy Boston:
This morning we attempted to bring in another military tent, a 16’x16’, which would be used for sleeping. We were stopped in our attempt and told a permit would be needed.
When we have asked how to go about permitting a tent, we have been told not to bother, as no tents we seek to permit will be approved, on principle that no permit was ever issued to be here, in Dewey Square, in the first place; or ever would be. This was stated on the stand in Suffolk Superior Court, by Mister Bart Shea, the City Fire Marshall. This ties our hands while demanding we scratch our own backs, or leave.
That’s fine for the paper, but what’s happening on the ground is that the various city agencies, covering their own liability, are telling us to come into code, while still other city offices, apparently, are using the police to enforce the prohibition of new materials; effectively halting our ability to come up to code without obfuscation.
The police will argue with us all day, they have an order barring in new materials, simple; it is the other, higher offices, which refuse to negotiate. We, at Occupy Boston, once again, would like to extend an invitation, to the Mayor of The City of Boston, Mr. Thomas Menino, to the Fire Marshal, noted above, and any other city regulators or officials willing to engage in this debate; to come and have an open dialogue, with the people, on the issue of how we can come to terms, on issues of safety, sanitation, and higher philosophy, to relate, and mediate our mutual interests, so that we can all move forward.
As for this morning, a general assembly was called at 11:30 to discuss the action. It had been discussed previously, in the wake of the sink incident, that a more cooperative and coherent demonstration was needed to best portray our particular situation to the public. We called on the various city agencies acting in apparent collusion to prevent us from coming into accord with their wishes, as well as the media, and you, to hear our polite requests for answers, as well as to raise further public awareness on this issue.
We were offered no answers, only that we needed a permit; a permit which we have been informed would never be granted. The tent was removed peaceably, only after we felt our message was heard; that we would like to become safer, more comfortable, more efficiently arranged, organized and accessible, so that more people may come, and be involved in this open discussion.

This is odd. We have not encountered this problem. Might we take part in your next general assembly to address any issues that Occupy Boston has overlooked? The final answer on this issue is not “no.” Of that I am sure. We may be able to pull a few strings for you all to get your winterized tent allowed, possibly even the sink. Pruneyard versus Robins says no permit is needed for peacefully protesting on public property. If you choose to use a tent, or to use posters, or to use cameras, it is still peaceful protest. If they choose to evict you, they are going against U.S. Supreme Court order from the 1980 court case, requiring public space to remain a specter for free speech of any kind that poses no harm to anyone. http://en.wikipedia.org/wiki/Pruneyard_Shopping_Center_v._Robins

While I’d certainly like it to be true, I just went to the Wikipedia page you show and read the article. It seems that Pruneyard vs Robins is a California state law and applies very specifically applies to the State of California and in particular to shopping centers and other similar types of private property which is open to the public. Although the Wikipedia article does say that Massachusetts has a very similar law, it still implies that it applies to private property which is open to the public – and doesn’t specifically cover public property (which one would assume free speech would be protected even more on public property than it would on private property). So unfortunately, this case law doesn’t look like it covers the Dewey Square encampment – yet one could use it to make a strong case about the Dewey Square encampment being protected as free speech with a law similar to Pruneyard vs Robins existing in Massachusetts.
A “military” tent. As a resident I don’t like to see any folks living in tents but whatev the mayor says it’s ok with him. There’s a lot of folks complaining about rising tuition rates too. There’s a huge military recruitment office downtown. They have great tuition reimbursement programs and the GI bill. In MA state schools waive tuition for veterans. And. And, you can sleep in a tent. No permit required. Bam! Just killed two birds one stone.
And BAM! you get to kill those “A-Rabs”, including civilians, and BAM! you get blasted by an I.E.D. and lose limbs and get PTSD, and BAM! the GI bill doesn’t work out as rosy as they made it sound in the recruiting office, and BAM! there go more trillions of taxpayer dollars on wars we should never have been in to begin with, or that should have ended long ago!
It is true though, going into a war under false pretenses, risking life and limb and sanity, killing others and possibly getting killed is definitely an option that the poorest and most disenfranchised members of our population opt for, hoping for those alleged benefits, that often never come to them in the end.

Is this you? Either way off the bat,presumably, you are a 911 truther who is not in touch with reality. Yes by enlisting or receiving a commission as an officer you may be deployed to a part of the world where the enemy is an “A-tab”(as you’ve described). Yes there have been civilians who have been killed. Yes IED’s remain one of the enemy’s most powerful weapons that can kill or take limb. In fact it reminds me of that show on bravo when the guy asks what is your least favorite word. Mine is shrapnel.
If you could please provide the info when the GI bill was not granted to a soldier/marine whoever… You allege benefits never come. Is this from experience. I suggest you have none.

Oh yeah as to my social standing I was from a family that owned a business and graduated with a B average. I was not disenchanted at all.
Do you like to see people sleeping in doorways, on cardboard, and behind electrical boxes? If you walk from Dewey Square any morning around 5 AM, you’ll count 20 or 30 people within an hour who are outside of Dewey Square, who would be very happy to have a tent and some amount of restful sleep. I am an Occupier who has a home elsewhere, and I count myself lucky. Many at Occupy Boston are truly homeless other than the 1/2 acre of grass that has become a de facto family. This is temporary, through the Winter, but as such, it is a lot better than many homeless people have experienced in past Winters, and a lot safer too, despite the City’s constant harping on safety. Of course, the City is correct, there are safety concerns, and Occupy Boston is addressing these as well as possible, but there is a bigger picture, and I would like to always keep in mind the safety concerns about a person sleeping with NO shelter whatsoever. That is a greater safety concern. I see where the City is coming from, but I ask all to have common sense, and to talk.
The City of Boston takes homelessness very seriously. There are at least 37 shelters in Boston including several day drop-in shelters. Many of these shelters provide counseling and other services. Please don’t imply that Dewey Square is the only place they can go. Boston tries very hard to convince homeless people to stay indoors during the night, especially during the winter.
Beth, I am not in the least implying that Dewey Square is the only place that people experiencing homelessness can go in the City. I’ve volunteered at Long Island and I know of the many other resources available. The one thing I often notice, though, is that many people experiencing homelessness don’t want to stay in a shelter for various reasons, like feeling unsafe in shelters for their own person or for their belongings, which apparently very often get stolen. There is also the issue of the mechanics of checking in to get a bed for the night, which I have heard cited many times by people experiencing homelessness — that the shelters are too restrictive in terms of the early time of day that you must enter to get a bed, and then cannot leave except for emergency reasons. That may have reason, but it may feel too close to being a sort of nightly confinement. Then there are the mandatory early wake up calls that I have heard of. Please don’t think I am criticizing the shelters. I am glad they exist. These are critiques that I have heard directly from people experiencing homelessness, and echo them almost verbatim here. That is why I think that a shelter started and run by people experiencing homelessness, and formerly homeless people, could be an excellent thing. (One shelter I have heard nearly all good things about, by the way, is Rosie’s Place — perhaps it has a different feeling because of a different spirit.)

Please don’t misunderstand when I say ‘beggars can’t be choosers’
OK, so the situation at this time is:
1. The city won’t allow any winter-ready tents/structures. In fact, it seems they won’t allow any new materials whatsoever to come in and the camp, as it stands, can’t survive a New England winter.
2. Menino isn’t going to stand by and watch somebody freeze to death in Dewey Square, so by citing reasons of safety he will order the camp closed and he will be backed by the court. (Probably sooner rather than later.)
3. Occupying some other site in lieu of Dewey Square is a pipe dream. The city was caught off guard the first time, but it won’t happen again.
So what now? A lot of the Occupy Wall Street folks come back to Zucotti Park every day but news coverage is almost nonexistant since the eviction. By losing their physical presence, they’ve lost a lot of their voice.
How does Occupy Boston keep the message strong after Dewey Square? Daily, well co-ordinated pop-up demonstrations? Something else? I hope it’s being talked about because Dewey Square’s days are numbered.
In the time remaining I hope everybody quits beating the dead horse of ‘Occupy’s right to occupy’, because the city has won that battle. The concentration, thought and energy has to be spent on what comes next. A boxer would say that you duck this punch and come up with a counter. And it better be quick and smart, before the legs go and the arms tire.
I’ve been advocating for O.B. to find a downtown (or leather district, or Chinatown) vacant warehouse or storefront space to use as a winter headquarters (like politicians do during their campaigns) for a while but nobody’s really taken interest. Well, I hear that the Winterization Working Group was looking into this so maybe someone from that group knows what the status is and could speak on that.
It would be great to have a safe 24/7 space for meetings, organizing, literature, the library, etc. There must be an Occupy sympathizer with a vacant space to offer for free or low rent. I too worry about the scattering if/when the camp goes, and would also love to see O.B. proudly march to a visible downtown HQ instead of getting bulldozed and teargassed. Then the attention could be more focused on the OWS message rather than just the issue of tents being allowed in Dewey,
Here’s what I see happening. First, I think the Tent Event went alright, though I think we fumbled the messaging a lot. It could have gone a lot better. Still, we showed a level of respect and it was reciprocated at about the same level.

I am proposing an end date to the Occupation at the General Assembly tonight. I will propose the Spring Equinox. I would like to see diplomacy work with the City. To do this, we will have to show more respect when it is due, and uplift ourselves as much as possible.

I think the geographic location is critical. This 1/2 acre of grass is symbolic and catalyzing. It is crucial that there are beating hearts there around the clock. Many people there are otherwise homeless, and their humanity is being affirmed by Occupy Boston, and it is seriously helping many people. For that reason alone, it is crucial. Yet it is also crucial because it stands for a spirit of nonviolent but fierce resolve to change the world for the better. This is an evolutionary revolution. We need to act from the source of love rather than greed. We need to simply be human, rise above the iron cage of laws and bureaucracy, and make it happen. We need to do what must be done, which is pretty clear to me in the broad strokes.

There is too much inequality. Inequality is a good thing, inasmuch as it is a motivator, and is apportioned roughly by true worth. Yet, no human being is worthless! How can we have human beings on our streets, sleeping on a piece of cardboard, while we step over them with our leather Boston shoes?

I know that Menino cares about homeless people as much, or more, than other City residents. He has a beating heart, and he’s a good person. He does the annual homeless census, which is coming up on December 12th, and he does care from his true heart about homeless issues. It is not a political stance, but one of principle.

I think that it would be possible to negotiate a compromise wherein Occupy Boston can remain with a smaller number of campers — perhaps 99 is a good number — through the Winter, to carry the message and keep the flame lit. We can do it safely and with dignity. We can make the camp a highly respectable place that would be welcoming to visitors. We could simmer down the general level of tension to the point where the City would feel comfortable with only one police officer on a monitoring duty, which would then be a cost to the City of zero dollars — if you consider that a single police officer in the financial district is already a good idea, and that the population of Dewey Square would probably be consuming the services of a single officer anyway, and would be centrally located and arranged in a self-help community that would take care of most problems to ensure safety and well-being. We also could figure in the cost of sheltering otherwise homeless residents who would be sheltered at zero cost to the City, in a very safe way, if we are allowed to bring in a few good tents, and to do so in an orderly and negotiated way with the City.

I don’t believe that the restraining order is the right way to handle this on a long term basis. It gave everyone some breathing room, and time to think, which is the point of an RO in the first place. I hope we can use this, and live up to our full potential — everyone: Occupy Boston, the Mayor’s Office, the Police, and the Fire Department. I have hope and faith that we can do so. We are all we have. We have each other, and we can work together.

I can tell you what Occupy’s next move should be: supporting a resource-based economy. If this (http://keemseek.wordpress.com/2011/11/30/another-way/)was our demand, maybe people would start listening to us.
I’m not a lawyer, but when push comes to shove (and it looks like that’s where this is going…) it may be useful to have physical proof (i.e. a registered letter, etc.) that you actually requested the permit(s). Because you were told that the permit would not be approved (…can you get that in writing?) may be insufficient proof that a good faith effort was actually put forth. If a permit is required and you don’t have it there’s very little to argue about. However If the permit request is made; either the request has to be ignored or it has to be denied. In either of those cases there is an argument to be considered. Just my 2 cents.
Actually the GI Bill works. I used it after 11 years the Army. So unless you have served done your time. I have. Shut it. You are not an expert on the matters.

You dont HAVE to join any organization to get an education. You can pay for one your self. you can go part time and work, you can forget about the “college experience” and take classes.
Nobody owes you a college education. It is a privilege. Dont start about not being able to get a job with out a degree because that is bull shit too. If you have skills and work hard and are smart you can get a job with or with out a degree. If you are a wine and wait for hand outs you wont get a job. Look at the greats, bill Gates, Ray Kroc, Coco Chanel, Colonel Sanders, Dave thomas,Debbie Fields John D. Rockefeller Sr., Mary Kay Ash, RICHARD BRANDON!!! there are thousands more.
It’s not about anyone owing anybody else an education. It’s about what resources our society has for the common good, and what we spend those resources on. Somehow we found literally trillions of dollars to prevent banks from seeing the consequences of their bad bets, and this helped who? Those few who own the banks. A tiny fraction of that money could be used to educate people who can’t afford college on their own, and that would benefit the whole society, based on the productive work these people could do and the innovations they could make.
I will answer you from my point of view. I don’t think that education is either a right or a privilege. I dislike both terms. “Privilege” makes one too servile, and “right” makes one too presumptuous.

The ground reality is that we are human beings in a society. Education is a valuable experience. I hope all people have to opportunity to get the education they desire. I desire a society in which as many as possible will have access to education. If you do not desire that, then I question your heart.

There are many ways to fund a college education. Some governments pay for most of a citizen’s education, within certain guidelines. In the U.S., the cost falls mainly on the student, with the “help” of student loans. I use quotes, because the student loan system is partially a product of the interest of lending institutions who got the current system in place in the early years of the Reagan administration, including the exclusion of student loans from personal bankruptcy.

The student loan system, as well as the GI bill, have led to an explosion in college costs. Tuition has risen at twice the rate of inflation for 40 years, and so the cost of an education has skyrocketed compared the the cost of other goods and to incomes. The ratio of a college education’s cost to average income has gone way up. Meanwhile, the worth of a college education has gone DOWN. A degree means a lot less than it did 20 years ago, in terms of job and income potential.

The use of college financing as a motivator for joining the military is, in my opinion, a mixed bag. It seems like a bribe to me, a bribe offered mainly to young people who are still forming their views on the world, and looking for a path. Those with few prospects are tempted to join the military because it gives them a life path that is laid out, the attraction of being part of a group, a mission that is romanticized, and a promise of money for education. Not that this is wrong, but it is important to remember that young people are young people … not in the position to make decisions that will bind them for the rest of their lives. For the same reason, I oppose the wholesale offering of credit cards to young people. I think it is a bad form of usury, and preys on the lack of judgement of many young people.

I paid for my college education, and still pay for it. It did me little good, and in hindsight I wish that I had educated myself. The most important things, I taught myself anyway. I worked my way through college and took loans.

Occupy is not a murderous organization. Thank you for the comprehensive list of headlines. It is true that there have been a lot of unfortunate events at or near Occupy camps. There have been unsavory actions taken by some individuals. But these camps involve far, far more people than are represented by the headline-grabbing events. It is also clear to me that the media loves to focus on crimes that happen at or near Occupy camps, while they would not report on such things that happen every day in the surrounding world at large. The Occupy camps are in one sense a microcosm of our society, representing the problems in the larger society. They do attract people who are more marginalized or damaged by our society than other places, partly by offering a level of existence that is higher than living on the street itself. There is community and a safety and health and food provision that does rival some official services, yet comes with a more humanizing feeling than many official service providers — by which I mean shelters. That is to the Occupy movement’s credit, not detriment. This does correlate with higher crime rates than the average population, but you must realize that these crimes would occur, in larger numbers, elsewhere. They do, every day, occur elsewhere, and with less of a watchful community around. The reason that police come to stop most of the confrontations that occur at an Occupy camp is because they are present nearby, and community members will alert them. Community members also de-escalate and mediate most conflicts, and police are not required to intervene with force.

You also see that people who have enough time to spare on a movement, which correlates to people who are unemployed or underemployed, will be the ones who can afford to stay at a camp. I do stay at a camp, but i also work. I took this week off from work because I think it’s a critical time in the history of Occupy Boston to get things right.

So that means there are actually many more criminal problems that are covered up – sounds like a mirror image of the current political environment that you are camping/singing/dancing/marching/meditating/yogaing/protesting against.

It IS great that the military has given us the freedom of speech, and given you an education and I’m sure most of the Occupiers thank you Scott. But the fact is that the modes of of war and the institution of government are NOT NEEDED anymore. We have a military, a government, money because there is still the illusion of scarcity on our planet. There is no scarcity, or at least there wouldn’t be if there was NO MONEY. We have advanced technologically beyond the point of needing money to meter out resources. What people need is access to resources, not access to money. We need a resource based economy. Regardless of how you feel about any said war I joined the military to be a soldier. It was a childhood dream. The college money was a bonus. I have actually saved many more lives than I have taken. I used the money to go to paramedic school. I have saved lives. I enjoy it. I also enjoyed my time in the army and don’t regret a single day of it.
Sadly I agree with a lot of the points of the occupy movement. It’s people like you that sway me away from it.

I’m sorry that I disagree with a majority of the movement. I am not on here to bash anyone. To each their own. Hell I was an infantry squad leader with a grateful dead tattoo.
The message has been heard and public support is sliding. I bet a more fundamental approach to protesting and giving up the square is best option.

I would have joined the military to be a soldier, as well, if i could have felt that it was working for peace and security and democracy as directly as it is supposed to. I learned too early about U.S. foreign policy in Central America and intervention in Vietnam, and lived through the first Gulf War as a teenager, hearing different viewpoints on why we were there. I didn’t join. Instead, I went to college, worked my way through, also did Habitat for Humanity for those years and learned to be a carpenter, then worked as a carpenter, and also did Peace Brigades International, where I served for human rights in the midst of a civil war in Nepal, a guerrilla war in the Himalayas. I served there for a total of 3 years over the course of 10 years. I respect and understand your decision to join the military. The U.S. military does many good things, and I respect all soldiers whose hearts are in the right place. We also have many returned soldiers, many of whom have PTSD symptoms, in the Dewey Square encampment. We have many veterans who think that this country is still worth fighting for, and that the most important enemy is the wealthy elite who have come to control the government to a huge degree, distorting our public policy in their favor. Please take these words as a peace offering and an apology for the harsh unthinking words of others.
We do not need the right to tents in this country. The Occupations have been fantastic for raising awareness, but they’re now becoming a burden.

I think that tents are still serving a useful purpose. They are holding a physical space for dialogue. Without that physical public space, which is our demand, we would not have the centered catalyzed movement that we currently have. It is a symbolic action, saying that reasonable people can understand that 1/2 acre of grass is a very low price to pay for the venue in which we can bring about a change in consciousness, hold an extended dialogue on the nature of American democracy at present and as we want it to become. There are some liability aspects to it. It is less clearly free speech than a placard, for example. However, it represents the huge inequality in our society, because a tent represents shelter. Why are there homeless people sleeping in doorways and on benches just a few blocks away from Occupy Boston? There were there before, and they will be there after Occupy Boston decamps. We also do have actual homeless people who have taken to living at Occupy Boston and hope it will survive through the Winter. There are City and other resources, but many homeless people prefer to stay at Occupy Boston because they have more of a voice and a community feeling, and are more empowered. There is a homelessness issues working group started by people who are homeless. The tent that we tried to bring in on Monday was donated by a homeless man to shelter other homeless people, bought with money he raised from private donations. The presence in the financial district is also a huge part of the message. It is symbolic and actual. Some of the people who really need to see this message, to see poverty in their midst, must pass by every day on their way to work. This will have an effect on their consciousness, and perhaps they will see things a bit differently every day that they see this encampment.

This protest camp and symbolic performance piece is not over. It is not permanent — it is definitely temporary — but it is not over yet. We must last through the Winter. We do have homeless people who may otherwise perish in the Winter. We need to negotiate a solution with the City to allow us to bring the camp up to reasonable safety standards, with an assurance that we are not here forever, just through the Winter, but that what we are doing is important to everyone who cares about homelessness and economic inequality, as well as real democracy.
Well sage I can honestly say that number o people I have killed, and I have killed, is far fewer than the lives I’ve saved. I went to Bosnia in 1995 to stop a Genocide, went again in 1998. 1999 Kosovo again in 2000. I went to Iraq in 2003 and 2004-2005. That is where I killed people. I killed because they were trying to kill me. I ended a regime that gassed it’s own people. Saddam killed more people than the US Military. I don’t care about the whole politics of WMDs or what not.
I was a soldier and was ordered to go to war. I went. I had my own reasons for fighting. Actually I had 10 million of them. The people I freed from oppression. Keep in mind the people I killed are the ones who murdered an 8yo girl named Noora that I carry of a picture of. Why was she killed? To terrorize a neighborhood that had befriended soldiers.
Scott, i hear you and understand. It’s not easy. There are no black and white answers. The world is too mixed up to say “this is right, and that is wrong” blindly.
